A Johannesburg legal consultant has won his fifth damages claim for unlawful arrest against the police.
According to a Beeld report, Lionel Greenberg was successful in his latest foray, winning of R30 000 and costs in the South Gauteng High Court. All the claims relate to the same case - a bitter divorce between Greenberg and his ex-wife, Dora. Greenberg was accused of family violence in terms of the Domestic Violence Act. He also won a damages claim against the NPA for his malicious prosecution. Greenberg has been granted damages of R275 000 to date and cost orders amounting to almost R700 000. In the latest case, he sued the police in connection with his arrest after being found outside Dora's house. The High Court held his arrest was unlawful as no warrant had been issued for his arrest and the Domestic Violence Act did not permit his arrest as there was 'no element of violence' involved when he camped outside Dora's house.
